By accessing or using Plai ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service. The Service is operated by ARTISTIC B.V.

2. Description of Service

Plai is a product management tool that helps you generate requirement specifications for software applications using AI models, and lets you send the requirement specifications to AI coding agents for implementation. The Service may include integration with various AI providers.

3. User Accounts

To access certain features of the Service, you may be required to create an account. You are responsible for:

• Maintaining the confidentiality of your account credentials

• All activities that occur under your account

• Notifying us immediately of any unauthorised use of your account

• Ensuring that your account information is accurate and up-to-date

4. Acceptable Use

You agree not to use the Service to:

• Violate any applicable laws or regulations

• Infringe upon the intellectual property rights of others

• Upload or transmit malicious code or harmful content

• Attempt to gain unauthorised access to the Service or its systems

• Interfere with or disrupt the Service or servers

• Use the Service for any illegal or unauthorised purpose

5. Intellectual Property

The Service and its original content, features, and functionality are owned by ARTISTIC B.V. and are protected by international copyright, trademark, and other intellectual property laws.

You retain ownership of any content you upload to the Service. By using the Service, you grant us a limited licence to process your content solely for the purpose of providing the Service to you.

6. Third-Party Services

The Service may integrate with or rely upon third-party services, including AI providers. Your use of such third-party services may be subject to their respective terms and conditions. We are not responsible for the availability, accuracy, or content of third-party services.

7. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, secure, or error-free.

8. Limitation of Liability

To the fullest extent permitted by law, ARTISTIC B.V. shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your use of the Service. Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.

9. Indemnification

You agree to indemnify and hold ARTISTIC B.V. harmless from any claims, losses, or damages arising from your content or your violation of these Terms.

10. Termination

We may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the Service will cease immediately. All provisions of these Terms which by their nature should survive termination shall survive.

Your use of the Service is also governed by our Privacy Policy at https://useplai.com/privacy-policy.

12. Changes to Terms

We reserve the right to modify or replace these Terms at any time. We will provide notice of any material changes by updating the "Last updated" date at the top of this page. Your continued use of the Service after any such changes constitutes your acceptance of the new Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of The Netherlands, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of the Service shall be subject to the exclusive jurisdiction of the courts of The Netherlands. For users outside the European Union, any disputes shall be resolved through binding arbitration in Amsterdam under the rules of the Netherlands Arbitration Institute, unless otherwise required by applicable law.
